Terms & Conditions

Content: All content available on the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, is the property of SwiftAMS or its content suppliers and is protected by United States and international copyright laws.
 

Restrictions on Your Use of the Service: You agree to use the Service only for lawful purposes and in accordance with this Agreement. You are prohibited from using the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. You may not use any automated system, including without limitation, "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the SwiftAMS.com servers than a human can reasonably produce in the same period.
 

Accounts: To use the Service, you must register for an account on the Service (an "Account"). You must be at least 18 years old to register for an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to ensure that it remains accurate, current, and complete.
 

Workspaces: The Service allows you to create and manage workspaces for personal use. You are responsible for all activities that occur under your workspace, and you agree to use the Service in accordance with this Agreement.
 

Interacting with Organizational Workspaces: If you are invited to join an organizational workspace by a SwiftAMS user or administrator, you agree to comply with the terms and conditions set forth in the applicable organizational agreement, in addition to this Agreement.
 

Subscriptions: SwiftAMS offers various subscription plans for the Service, which may be subject to additional terms and conditions. By subscribing to the Service, you agree to pay all applicable fees and taxes, which are non-refundable except as expressly provided in this Agreement.
 

Fees and Fee Changes: SwiftAMS reserves the right to change its subscription fees and to introduce new charges at any time, upon at least 30 days' prior notice to you, which notice may be provided by email or by posting the new fees on the SwiftAMS.com website.
 

Free Trial: SwiftAMS may offer a free trial period during which you can try the Service for free. If you do not cancel your subscription before the end of the free trial period, you will be charged for the subscription plan you selected when you signed up for the free trial.
 

Refunds: If you are not satisfied with the Service, you may request a refund within 30 days of your initial purchase of a subscription. Refunds will be provided at SwiftAMS's sole discretion.
 

Communications from SwiftAMS: By using the Service, you agree to receive certain communications from SwiftAMS, such as service announcements, administrative messages, and other promotional materials. You can opt out of receiving certain communications by changing your notification settings in your Account.
 

Copyright Policy: SwiftAMS respects the intellectual property rights of others and expects its users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please follow our Copyright Policy, which is available on the SwiftAMS.com website.
 

Intellectual Property: All materials, information, software, products, and services included in or available through the Service are protected by copyright, trademark, and other laws. The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by SwiftAMS or its licensors, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
 

Feedback: If you provide any feedback, comments, or suggestions for improvements to the Service ("Feedback"), you agree that SwiftAMS may use and incorporate such Feedback without any obligation to you.
 

SwiftAMS Gallery and Non-SwiftAMS Services; Templates; SwiftAMS API: SwiftAMS may offer access to third-party services or links to third-party websites and resources. SwiftAMS has no control over such third-party services or resources and is not responsible for their availability or content. SwiftAMS makes no representations or warranties with respect to any non-SwiftAMS services or resources, including, but not limited to, the SwiftAMS Gallery, templates, and the SwiftAMS API.
 

Termination: SwiftAMS reserves the right to terminate your use of the Service at any time without notice, for any reason or no reason.
 

Indemnification: You agree to indemnify, defend, and hold harmless SwiftAMS, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
 

Limitations of Liability: SwiftAMS will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from: (i) the use or inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; or (v) any other matter relating to the Service.
 

Disclaimer: The Service is provided "as is" and without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
 

Exclusions: Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you.
 

Mobile App Terms: In addition to these Terms, your use of the SwiftAMS mobile application is governed by the Apple App Store Terms and Conditions or Google Play Terms of Service, as applicable.
 

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
 

Compliance with Trade Controls: You agree to comply with all applicable trade control laws and regulations, including but not limited to the laws and regulations of the United States, the European Union, and India. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country.
 

Arbitration and Class Action Waiver: Any dispute arising out of or related to these Terms or your use of our software shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. You agree that you may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
 

India Residents: If you are a resident of India, you agree to comply with all applicable laws and regulations, including but not limited to the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
 

Changes: We may modify these Terms at any time without notice. By continuing to use our software after any such modification, you agree to be bound by the modified Terms.
 

Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
 

Entire Agreement: These Terms constitute the entire agreement between you and SwiftAMS with respect to the use of our software and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and SwiftAMS.
 

Survival: The provisions of these Terms which by their nature should survive termination shall survive termination, including but not limited to provisions regarding intellectual property, limitations of liability, indemnification, and arbitration.
